PART A - Using our website

1. Who we are

This website, www.actizyme.com.au, is operated by Actizyme Australia Pty Ltd (ABN 59 664 976 998), 8 Elliott Road, Dandenong South VIC 3175. In these terms, "we", "us" and "our" mean Actizyme Australia Pty Ltd, and "you" means the person using the website or buying from us.

2. Accepting these terms

By using the website or buying from us, you agree to these terms. If you do not agree, please do not use the website.

3. Changes to these terms

We may update these terms from time to time by posting the updated version on this page. Changes do not affect any order already placed. Your continued use of the website after we post changes means you accept them.

4. Availability

We try to keep the website available and accurate, but we do not guarantee it will always be available, uninterrupted or error free. We may suspend or withdraw part or all of the website for maintenance or business reasons.

5. Who can use the website

The website is intended for customers in Australia who are at least 18 years old. We sell and ship within Australia only.

6. Our intellectual property

All content on the website (including text, images, logos, designs and product information) is owned by or licensed to us and is protected by law. You may view and print it for your own personal, non-commercial use. You may not copy, reproduce or use it commercially without our written permission.

"Actizyme" and "Eco-Zyme", and our logos, are registered trade marks of Actizyme Australia Pty Ltd. You may not use them without our written permission.

7. Information on the website

Information on the website, including how-to guides, dosing information and tips, is general information only. Always follow the directions and safety information on the product label. General information on the website is not a substitute for the product directions and does not limit your rights under the Australian Consumer Law.

8. Reviews and content you submit

If we enable reviews or other places for you to submit content, you are responsible for what you submit, and you must not submit anything unlawful, misleading, offensive or that infringes someone else's rights. By submitting content you give us permission to use it in connection with our business. We may remove content at our discretion.

9. Acceptable use

You must not use the website for any unlawful purpose, to interfere with or damage it, to introduce malicious code, to collect other people's information, or to scrape or copy it using automated tools. We may suspend your access if you breach these terms.

10. Third-party links

The website may link to other websites we do not control. We are not responsible for their content or practices, and a link does not mean we endorse them.

11. Our liability for website use

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot be excluded (see Part B for your rights when you buy from us). Subject to that, we are not liable for any loss arising from your use of the website to the extent the law allows, and we exclude liability for indirect or consequential loss.

PART B - Buying from us

12. Orders and when a contract is formed

When you place an order, you make an offer to buy the products in it. We will send an order confirmation acknowledging we have received your order. A contract is formed only when we dispatch the products to you. We may accept or decline any order.

You agree to give us current, complete and accurate order and contact details.

13. When we may decline an order

We may decline or cancel an order (for example) if a product is out of stock, if there was an error in the price or description, if we suspect fraud or misuse, or if the order looks like it is for resale rather than personal or household use. If we cancel an order you have paid for, we will refund you within 10 business days.

Our online products are sold for personal and household use. For wholesale or trade enquiries, please contact us at info@actizyme.com.au.

14. Prices and payment

Prices are shown in Australian dollars and include GST where applicable. Delivery charges are shown separately at checkout and are additional to the product price.

We may change prices at any time, but changes do not affect orders already placed. If a pricing error affects your order, we will contact you to confirm whether you want to proceed at the correct price or cancel.

Payment is processed securely by Stripe. We accept credit and debit cards and, on supported devices, digital wallets such as Google Pay and Apple Pay. If your payment fails, we may cancel the order.

15. Delivery

We deliver within Australia only, using Australia Post. Delivery costs are shown at checkout, and delivery times follow Australia Post's standard estimates. If delivery is delayed by something beyond our control, we will let you know. If an order cannot be delivered because of an incorrect address or a failure to accept delivery, we may charge for redelivery.

16. Risk and title

Risk in the products passes to you on delivery. Title to the products remains with us until you have paid for them in full.

17. Product use and safety

Our products are cleaning products containing natural enzymes and micro-organisms. Please use them only in accordance with the directions and safety information on the label, including keeping them out of reach of children. Following the directions does not limit your rights under the Australian Consumer Law.

18. Your consumer rights

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. For a failure that does not amount to a major failure, you are entitled to have the problem fixed and, if it cannot be fixed within a reasonable time, to a refund.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Block Free Guarantee (voluntary). Some of our products carry a separate voluntary Block Free Guarantee, shown by the Block Free Guarantee logo on the pack. That guarantee applies on its own terms and conditions, in addition to your rights under the Australian Consumer Law. It does not replace or limit those rights.

19. Our liability when you buy from us

Nothing in these terms excludes, restricts or modifies your rights under the Australian Consumer Law. We also do not exclude liability for death or personal injury caused by our negligence, or for fraud.

Subject to the above, and to the extent the law allows, our liability for any product is limited (at our option) to replacing the product or supplying an equivalent, or paying the cost of doing so, and we are not liable for indirect or consequential loss.

20. Events outside our control

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, such as natural disasters, epidemics, industrial action, failures of transport or utilities, or government action. Our obligations are suspended while the event continues.

PART C - General

21. Governing law

These terms are governed by the laws of the State of Victoria and the Commonwealth of Australia, and you and we submit to the courts of Victoria.

22. Severability

If any part of these terms is found to be invalid or unenforceable, that part is severed and the rest continues to apply.

23. Entire agreement

These terms and our Privacy Policy are the entire agreement between you and us about your use of the website and your purchases. Nothing in them limits your rights under the Australian Consumer Law, including in relation to misleading or deceptive conduct.

24. Transfer

You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours, and we will make sure your rights are not affected.

25. Privacy

We handle your personal information in accordance with our Privacy Policy at www.actizyme.com.au/privacy-policy.
